Cheryl Cole is set to confront Simon Cowell in court as she steps up her legal challenge to her US X Factor sacking.
The 30-year-old singer is reportedly seeking £3.5million, after being fired from the panel just three weeks into the role.
Cheryl is said to have turned down offers to settle with the show’s makers Blue Orbit and wants to find out exactly how much Simon and the other judges earn from the show, The Mirror reports.

A source tole The Mirror: ‘“This paperwork is a clear sign that Cheryl wants her day in court. She is pushing for full fees… £2million, legal fees and a bonus, which could total £3.5million. Cheryl will learn what Simon earned and her co-stars too.’
‘Those papers could be the smoking gun if she can show others have been treated differently to her. The confidentially of discovery order means much of his testimony is unlikely to become public. Had it not been signed, the trial would have been the most explosive reality show trial.’
Simon, 53, will be called as a key witness during the trial.

The singer is said to claim that she was promised £1.5million for a second series of the show, regardless of how the first series played out.
She was paid £1.2million for her brief appearance in 2011 but is now reportedly looking for the money for the second series as well as other expenses.

While fans might be hoping to watch the drama unfold inside the courtroom Judge Abraham Klein has ruled that the details must be kept secret.
The 30-year-old singer has refused point blank to settle with makers Blue Orbit and instructed lawyers to quiz the music mogul along with judges LA Reid and Paula Abdul on how much they earn.
A Los Angeles judge gave her the green light to see the trio’s contracts. She will call Cowell, 53, as key witness.
But fans hoping for a public airing of The X Factor chief’s wages are in for a blow – Judge Abraham Klein ruled contract details must be kept secret.
A spokesperson for Cheryl was unavailable for comment on Monday.
Cheryl fell out with Simon after being sacked from the show but the pair have since made up.
The Syco boss bought the singer a piece of land in Scotland that gave her a title – meaning she is now Lady Cheryl Cole.
